Sans qu\u2019il soit requis de saisir des commandes sp\u00e9cifiques, elles peuvent prendre des instructions, \u00e9laborer un plan, utiliser des outils pour ex\u00e9cuter des t\u00e2ches et g\u00e9n\u00e9rer des r\u00e9sultats dynamiques.<\/em>\u00bb<\/p><\/div><\/div><\/div><\/div><\/section>\n\n\n\n<section class=\"wp-block-cg-blocks-group undefined section section--article-content\"><div class=\"article-main-content\"><div class=\"container\"><div class=\"row\"><div class=\"col-12 col-md-11 col-lg-10 offset-md-1 offset-lg-1\"><div class=\"article-text article-quote-text\">\n<p>En somme, l\u00e0 o\u00f9 l&#8217;IA g\u00e9n\u00e9rative est principalement utilis\u00e9e pour cr\u00e9er du contenu \u00e0 partir de diff\u00e9rents formats, images, textes, musique, vid\u00e9os\u2026 l&#8217;IA agentique analyse les donn\u00e9es et peut fixer des objectifs et des strat\u00e9gies : c&#8217;est l&#8217;IA orient\u00e9e vers l&#8217;action.<\/p>\n\n\n\n<p>L&#8217;IA agentique gagne rapidement du terrain et promet de devenir une tendance majeure dans le secteur public. En se concentrant non seulement sur la planification des t\u00e2ches, mais aussi sur l&#8217;atteinte d&#8217;objectifs concrets, cette technologie permettrait aux agents de g\u00e9rer leurs \u00ab&nbsp;propres services num\u00e9riques&nbsp;\u00bb aliment\u00e9s par l&#8217;IA. &nbsp;En France, la lutte contre la fraude pourrait \u00eatre le premier sujet \u00e0 b\u00e9n\u00e9ficier de ces avanc\u00e9es.<\/p>\n\n\n\n<p>Dans un contexte de contraintes budg\u00e9taires, la capacit\u00e9 du gouvernement fran\u00e7ais \u00e0 collecter des imp\u00f4ts et \u00e0 assurer un traitement \u00e9gal entre les citoyens est une priorit\u00e9. Le montant de la fraude fiscale est estim\u00e9, en fourchette haute, entre <a href=\"https:\/\/www.vie-publique.fr\/en-bref\/295696-lia-au-service-de-la-lutte-contre-la-fraude-fiscale\">80 et 120 milliards d&#8217;euros<\/a> par an (par non-paiement dans les d\u00e9lais, dissimulation intentionnelle de montants soumis \u00e0 l&#8217;imp\u00f4t, organisation de l&#8217;insolvabilit\u00e9, fraude comptable, etc.), ce qui <a href=\"https:\/\/www.budget.gouv.fr\/budget-etat\/ministere\">\u00e9quivaut<\/a> au budget annuel du minist\u00e8re de l&#8217;\u00c9conomie, des Finances et de l&#8217;Industrie. La fraude sociale, quant \u00e0 elle, est estim\u00e9e \u00e0 environ <a href=\"https:\/\/www.vie-publique.fr\/rapport\/295536-hcfips-lutte-contre-la-fraude-sociale-etat-des-lieux-et-enjeux\">13 milliards d\u2019euros<\/a> par an, selon un rapport de 2024 du Haut Conseil pour le financement de la protection sociale.<\/p>\n\n\n\n<p>M\u00eame si les ordres de grandeurs sont diff\u00e9rents, l\u2019appr\u00e9ciation de ces volumes ne peut qu\u2019\u00e9br\u00e9cher l\u2019adh\u00e9sion au principe du consentement \u00e0 l\u2019imp\u00f4t (et aux cotisations sociales)<em>. <\/em>Diff\u00e9rence de traitement, doute et perte d\u2019adh\u00e9sion au corps social\u2026 les maux associ\u00e9s \u00e0 la fraude ne sont pas que financiers. Et dans tous les cas, l&#8217;\u00e9quit\u00e9 n\u2019en sort pas gagnante. Arriv\u00e9e \u00e0 pleine maturit\u00e9, l\u2019IA agentique pr\u00e9sente de s\u00e9rieux gages pour s\u2019attaquer sur de nouvelles bases \u00e0 ce ph\u00e9nom\u00e8ne.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-la-perspective-faire-un-pas-de-geant-dans-la-lutte-contre-la-fraude\">La perspective : faire un pas de g\u00e9ant dans la lutte contre la fraude<\/h2>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-une-equipe-derriere-chaque-agent-nbsp\">Une \u00ab \u00e9quipe \u00bb derri\u00e8re chaque agent&nbsp;<\/h4>\n\n\n\n<p>En utilisant l&#8217;IA agentique, les contr\u00f4leurs fiscaux pourraient s&#8217;appuyer sur des machines pour g\u00e9rer des t\u00e2ches complexes &#8211; croisement de diff\u00e9rents fichiers, mise en place de syst\u00e8mes de surveillance &#8211; afin de mobiliser leur \u00e9nergie et leur expertise sur des initiatives strat\u00e9giques. Une IA capable de consulter de multiples bases de donn\u00e9es et d\u2019en tirer les informations pertinentes contribuerait \u00e0 d\u00e9multiplier la force de frappes des contr\u00f4leurs, leur permettant de se concentrer sur des domaines plus complexes et d\u00e9licats \u00e0 appr\u00e9hender tels que les montages complexes et souvent internationaux de fraudes fiscales, le blanchiment d\u2019argent via les cryptomonnaies\u2026<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-reactivite-et-adaptabilite-nbsp-dans-l-identification-des-mouvements-de-fraude\">R\u00e9activit\u00e9 et adaptabilit\u00e9&nbsp;dans l\u2019identification des mouvements de fraude<\/h4>\n\n\n\n<p>En mati\u00e8re de fraude fiscale internationale, la r\u00e9activit\u00e9 est essentielle&nbsp;: les d\u00e9lais de traitement sont source de pertes financi\u00e8res importantes pour les \u00c9tats. Ils en ont pris acte et le recours \u00e0 l&#8217;analyse des donn\u00e9es appliqu\u00e9e \u00e0 la d\u00e9tection de la fraude en temps r\u00e9el est globalement en hausse : par exemple, le <a href=\"https:\/\/www.capgemini.com\/us-en\/news\/client-stories\/business-intelligence-technology-helps-hmrc-increase-yield\/\">UK HM Revenue and Customs<\/a> (HMRC \u2013 administration fiscale et douani\u00e8re du Royaume-Unis) utilise un syst\u00e8me appel\u00e9 &#8220;Connect&#8221; pour analyser de vastes quantit\u00e9s de donn\u00e9es provenant de diverses sources, leur permettant d&#8217;identifier plus efficacement les cas de fraude potentiels. En Espagne, le <a href=\"https:\/\/sede.agenciatributaria.gob.es\/Sede\/en_gb\/notas-prensa\/notas-prensa\/2018\/enero\/23\/sii-nueva-informacion-cuentas-financieras-fraude.html\">Suministro Inmediato de Informaci\u00f3n<\/a> (SII), qui contraint les entreprises \u00e0 d\u00e9clarer les transactions de TVA dans un d\u00e9lai de quatre jours, permet aux autorit\u00e9s fiscales de surveiller et de r\u00e9agir \u00e0 la fraude potentielle presque en temps r\u00e9el.<\/p>\n\n\n\n<p>En allant au-del\u00e0 du croisement des donn\u00e9es, l\u2019IA agentique ouvrirait de nouveaux horizons en \u00e9tablissant des strat\u00e9gies personnalis\u00e9es, applicables en temps r\u00e9el. Surtout, elle sera \u00e0 m\u00eame, contrairement aux mod\u00e8les non supervis\u00e9s, de d\u00e9couvrir \u00ab&nbsp;par elle-m\u00eame&nbsp;\u00bb de nouveaux mod\u00e8les, gage d\u2019adaptabilit\u00e9 face \u00e0 l\u2019agilit\u00e9 des fraudeurs pour aller chercher les volumes d\u2019imp\u00f4t encore non collect\u00e9s.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-etendre-le-champ-de-recherche\">\u00c9tendre le champ de recherche<\/h4>\n\n\n\n<p>La Direction G\u00e9n\u00e9rale des Finances Publiques (DGFIP) a d\u00e9cid\u00e9 de lancer d\u00e8s 2013 un programme ax\u00e9 sur le \u00ab ciblage de la fraude et l&#8217;am\u00e9lioration des requ\u00eates \u00bb (CFVR) pour moderniser ses m\u00e9thodes de travail.<\/p>\n\n\n\n<p>Par exemple, le programme \u00ab <a href=\"https:\/\/www.impots.gouv.fr\/actualite\/1-les-grandes-lignes-du-projet-du-foncier-innovant-afin-de-garantir-une-meilleure\">Foncier Innovant<\/a> \u00bb est bas\u00e9 sur l&#8217;analyse crois\u00e9e, utilisant l&#8217;IA, des donn\u00e9es de photographies a\u00e9riennes de l&#8217;Institut National de l&#8217;Information G\u00e9ographique et Foresti\u00e8re (IGN) et des d\u00e9clarations faites par les propri\u00e9taires fonciers aux services d&#8217;urbanisme et d&#8217;administration fiscale. \u00c0 la suite d\u2019une campagne men\u00e9e dans 9 d\u00e9partements, ce sont plus de 20 000 piscines non d\u00e9clar\u00e9es qui ont \u00e9t\u00e9 tax\u00e9es en 2022 gr\u00e2ce \u00e0 cet outil, g\u00e9n\u00e9rant pr\u00e8s de 10 millions d&#8217;euros de recettes suppl\u00e9mentaires dans les recettes de l\u2019Etat. Depuis 2023, ce syst\u00e8me est \u00e9tendu \u00e0 toute la France m\u00e9tropolitaine.<\/p>\n\n\n\n<p>Mobiliser le potentiel de l\u2019IA agentique pour identifier des sch\u00e9mas complexes, en la combinant avec des outils de traitement de la donn\u00e9e massive et h\u00e9t\u00e9rog\u00e8ne permettrait \u2013 par exemple &#8211; de scanner efficacement le darkweb qui concentre les activit\u00e9s de fraude et autres actes ill\u00e9gaux&nbsp;: les fausses ordonnances et les arr\u00eats maladie fictifs y sont notamment revendus. Le montant r\u00e9cup\u00e9r\u00e9 par <a href=\"https:\/\/www.corsematin.com\/article\/economie\/1564350895351515\/fraude-sociale-en-corse-plus-de-2-4-millions-deuros-interceptes-par-la-cpam\">une CPAM<\/a> durant l&#8217;\u00e9t\u00e9 2024 (2,4 millions d&#8217;euros) r\u00e9v\u00e8le en creux l&#8217;ampleur de la fraude qui s\u2019op\u00e8re \u00e0 l\u2019\u00e9chelle nationale et l\u2019int\u00e9r\u00eat d\u2019exp\u00e9rimenter et d\u2019investiguer toutes les donn\u00e9es, o\u00f9 qu\u2019elles soient. Dans une logique de \u00ab&nbsp;r\u00e9ponse et action&nbsp;\u00bb, l\u2019IA agentique serait \u00e9galement \u00e0 m\u00eame d\u2019alerter les Caisses en temps r\u00e9el, voire de suspendre des versements au-del\u00e0 d\u2019un certain montant le temps que la situation soit analys\u00e9e et la r\u00e9alit\u00e9 de la fraude confirm\u00e9e.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-internationaliser-la-lutte\">Internationaliser la lutte<\/h4>\n\n\n\n<p>Parce que la fraude fiscale transcende les fronti\u00e8res, il est essentiel d&#8217;adopter des strat\u00e9gies de lutte \u00e0 l&#8217;\u00e9chelle mondiale.<\/p>\n\n\n\n<p>L&#8217;analyse multilingue est cruciale pour comprendre et combattre la fraude fiscale. Par exemple, le groupe ChapsVision, sp\u00e9cialis\u00e9 dans les solutions souveraines d\u00e9di\u00e9es \u00e0 la cyber intelligence et la cybers\u00e9curit\u00e9, dispose d\u2019un outil de traduction prenant en charge 55 langues et plus de 150 dialectes. Articul\u00e9 autour du syst\u00e8me d&#8217;exploitation d\u00e9velopp\u00e9 sp\u00e9cifiquement pour traiter des donn\u00e9es massives et h\u00e9t\u00e9rog\u00e8nes (ArgonOS), cet outil vise \u00e0 aider les autorit\u00e9s \u00e0 surveiller et \u00e0 lutter contre les activit\u00e9s criminelles en interpr\u00e9tant avec pr\u00e9cision jargon et argot. Sur la base de ces informations devenues exploitables, l&#8217;IA agentique aidera \u00e0 analyser de grands ensembles de donn\u00e9es pour d\u00e9tecter les anomalies et les sch\u00e9mas indicatifs de fraude, tels que des transactions financi\u00e8res inhabituelles et des structures complexes pouvant indiquer une \u00e9vasion fiscale ou un blanchiment d&#8217;argent.<\/p>\n\n\n\n<p>\u00c9largissement du spectre des langues identifi\u00e9es, int\u00e9gration de l&#8217;audio et de la vid\u00e9o parmi les donn\u00e9es utilis\u00e9es pour d\u00e9tecter la fraude, cadre international a priori favorable : le contexte semble propice pour acc\u00e9l\u00e9rer, gr\u00e2ce \u00e0 la force de frappe de l&#8217;IA agentique combin\u00e9e \u00e0 la capacit\u00e9 de traduction instantan\u00e9e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-mettre-le-respect-des-regles-ethiques-au-centre-des-preoccupations\"><strong>Mettre le respect des r\u00e8gles \u00e9thiques au centre des pr\u00e9occupations<\/strong><\/h2>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-cadres-de-gouvernance-et-de-conformite-pour-l-ia-agentique-relever-les-defis-ethiques-et-reglementaires\">Cadres de gouvernance et de conformit\u00e9 pour l&#8217;IA agentique : relever les d\u00e9fis \u00e9thiques et r\u00e9glementaires<\/h4>\n\n\n\n<p>\u00c9tablir des cadres de gouvernance et de conformit\u00e9 clairs pour l&#8217;IA agentique est essentiel, tant pour d\u00e9finir les r\u00f4les des parties prenantes que pour garantir une utilisation \u00e9thique de l&#8217;IA.<\/p>\n\n\n\n<p>La question de la transparence et de l\u2019explicabilit\u00e9 des d\u00e9cisions prises par ces syst\u00e8mes est d\u2019autant plus cruciale qu\u2019elle serait utilis\u00e9e pour pr\u00e9parer des contr\u00f4les sur les citoyens. Pr\u00e9venir les biais, prot\u00e9ger la vie priv\u00e9e, attribuer les responsabilit\u00e9s sont autant d\u2019objectifs qui devront guider les pouvoirs publics dans la mise en place de syst\u00e8mes d\u2019IA agentique.<\/p>\n\n\n\n<p>En France, la lutte contre la fraude sociale met particuli\u00e8rement en \u00e9vidence les d\u00e9fis \u00e9thiques et de transparence associ\u00e9s aux m\u00e9thodes de croisement des donn\u00e9es. Un <a href=\"https:\/\/www.senat.fr\/rap\/r23-491\/r23-4911.pdf\">rapport<\/a> incontournable de la d\u00e9l\u00e9gation \u00e0 la prospective du S\u00e9nat (02\/04\/24) nous en donne une illustration particuli\u00e8rement saisissante.<\/p>\n\n\n\n<p>Depuis 2011, les caisses d&#8217;allocations familiales (CAF) utilisent un algorithme de data mining pour planifier les inspections d&#8217;environ 13,8 millions de foyers b\u00e9n\u00e9ficiaires. Ces inspections sont effectu\u00e9es sur place par 700 inspecteurs asserment\u00e9s, sur la base d\u2019une d\u00e9cision humaine, donc non automatis\u00e9e, conform\u00e9ment au cadre r\u00e9glementaire en vigueur et aux directives l\u00e9gales et de la CNIL. Par ailleurs, l&#8217;algorithme ne croise pas les donn\u00e9es avec France Travail.<\/p>\n\n\n\n<p>Constat relativement contre-intuitif&nbsp;: il s&#8217;av\u00e8re que les m\u00e9thodes purement statistiques produisent des r\u00e9sultats plus subjectifs que les outils bas\u00e9s sur l&#8217;IA, car la d\u00e9cision d&#8217;utiliser les 40 crit\u00e8res dans l&#8217;algorithme demeure discr\u00e9tionnaire. Avec l&#8217;apprentissage automatique non supervis\u00e9, ce probl\u00e8me n&#8217;existerait pas, car aucun crit\u00e8re n&#8217;est donn\u00e9 \u00e0 la machine a priori : en les apprenant elle-m\u00eame, le contenu devient ainsi plus objectif.<\/p>\n\n\n\n<p>Le sujet n&#8217;est donc pas simple, et l&#8217;expansion des possibilit\u00e9s ouvertes par l&#8217;IA agentique appelle, au-del\u00e0 des mesures \u00e9thiques, un v\u00e9ritable effort d&#8217;\u00e9ducation \u2013 et d&#8217;argumentation \u2013 envers le public ainsi que les administrations pour en tirer le meilleur parti.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"h-necessite-d-un-reel-partage-des-donnees\">N\u00e9cessit\u00e9 d&#8217;un r\u00e9el partage des donn\u00e9es<\/h4>\n\n\n\n<p>Comme le rappellent les s\u00e9nateurs dans le rapport du S\u00e9nat \u00e9voqu\u00e9 ci-dessus, <em>\u00ab le v\u00e9ritable enjeu reste celui de l&#8217;\u00e9change d&#8217;informations entre les administrations : ceux-ci sont pr\u00e9vus par une s\u00e9rie de protocoles ad hoc sign\u00e9s bilat\u00e9ralement et au cas par cas <em>\u00bb<\/em><\/em>. Ils notent \u00e9galement que <em>\u00ab<\/em> <em>sur les 35 mesures du plan anti-fraude 2023, pr\u00e8s de la moiti\u00e9 de celles qui ne sont pas encore mises en \u0153uvre concernent les \u00e9changes d&#8217;informations <em>\u00bb<\/em><\/em>. Ainsi, le partage d&#8217;informations entre les administrations n&#8217;est pas seulement souhaitable, mais essentiel. Un effort de pr\u00e9paration &#8211; ambitieux &#8211; &nbsp;est donc d\u00e9terminant pour pr\u00e9parer l&#8217;av\u00e8nement de l&#8217;IA agentique, afin que son potentiel soit exploit\u00e9 pleinement tout en conservant une haute exigence vis-\u00e0-vis du respect de la r\u00e8gle de droit &#8211; &nbsp;quand elle est \u00e9nonc\u00e9e &#8211; et de l\u2019\u00e9thique.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-avancees-technologiques-disruptives-problemes-organisationnels-classiques\"><strong>Avanc\u00e9es technologiques disruptives, probl\u00e8mes organisationnels classiques<\/strong><\/h2>\n\n\n\n<p>En somme, les progr\u00e8s autour de l&#8217;IA agentique sont susceptibles d\u2019am\u00e9liorer consid\u00e9rablement les t\u00e2ches quotidiennes des agents publics. Au premier rang, la lutte contre la fraude pourrait \u00eatre un premier terrain de jeu prometteur.<\/p>\n\n\n\n<p>Des obstacles seront toujours sur la route du progr\u00e8s technologique, y compris s\u2019il sert <em>in fine<\/em> des objectifs d\u2019int\u00e9r\u00eat g\u00e9n\u00e9ral.
